These Terms of Use (“Terms”) govern your access to and use of the website at example.com (the “Site”), operated by Product Engineering (“we”, “us”, “our”), a company incorporated in India.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Purpose of the Site
The Site provides general information about our software design and development services. The Site is informational and promotional in nature. It is intended for use by businesses and professionals, not by consumers.
2. No Professional Advice
Content on the Site is provided for general informational purposes only. It does not constitute legal, regulatory, compliance, medical, or other professional advice, and it should not be relied upon as such. Please also see our Disclaimer, which forms part of these Terms.
3. Enquiries and Consultation Requests
The Site includes a contact form through which you may request a consultation or share details of a potential project. By submitting the form, you acknowledge and agree that:
- submitting an enquiry does not create a contract, engagement, partnership, or professional relationship between you and us
- any services we provide will be governed exclusively by a separate written agreement (such as a master services agreement, statement of work, non-disclosure agreement, or data processing agreement) signed by both parties, and nothing on the Site forms part of any such agreement unless expressly incorporated in writing
- we are under no obligation to respond to any enquiry or to accept any engagement
- the information you submit must be accurate and must be information you are authorised to share
- you must not submit patient information, protected health information, sensitive personal data, trade secrets, or other confidential information through the form. Confidential material should be shared only after appropriate agreements (such as a non-disclosure agreement) are in place.
4. Intellectual Property
The Site and its contents, including text, graphics, logos, page layouts, case study descriptions, and the software powering the Site, are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for legitimate business and informational purposes. Except as permitted by law, you may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content on the Site without our prior written consent.
Third-party names, marks, and logos referenced on the Site (including the names of regulatory frameworks and standards) belong to their respective owners. Their use on the Site does not imply any affiliation with, or endorsement by, those owners.

Case studies and project descriptions presented on the Site are provided for illustrative purposes and reflect information as at the “Last updated” date. They describe specific past engagements and do not constitute a guarantee, warranty, or prediction of the results of any future engagement. Outcomes depend on factors specific to each project and client.
7. Compliance Framework References
References on the Site to laws, regulations, and standards, such as GDPR, SOC 2, and similar frameworks, describe practices that inform our engineering and development work. They are not certifications of, or guarantees regarding, the compliance of us, the Site, or any software we build. Responsibility for regulatory compliance of any product rests with the client organisation.
8. Third-Party Websites
The Site may contain links to third-party websites or resources. These links are provided for convenience only. We do not control and are not responsible for the content, products, services, or privacy practices of third-party sites, and linking does not imply endorsement.
9. Privacy
Our collection and use of personal data through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of Warranties
The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any content is complete, accurate, or current.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Product Engineering and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your access to or use of (or inability to access or use) the Site or its content, whether based in contract, tort (including negligence), statute, or otherwise, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to your use of the Site shall not exceed INR 10,000 (Indian Rupees Ten Thousand).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Indemnity
You agree to indemnify and hold harmless Product Engineering and its directors, officers, and employees from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
13. Changes to the Site and These Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms from time to time. The updated Terms will be posted on the Site with a revised “Last updated” date, and your continued use of the Site after posting constitutes acceptance of the revised Terms.
14. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Site, shall be governed by and construed in accordance with the laws of India. Subject to any mandatory provisions of applicable law, the competent courts in India shall have exclusive jurisdiction over any such dispute or claim.
15. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and us regarding use of the Site and supersede any prior understandings on that subject. You may not assign your rights under these Terms; we may assign ours in connection with a corporate transaction.
